CONSTRUCTION DEFECT RESOLUTIONS

  • Construction Defect Action – 120 Unit Condominium Conversion Project, Oxnard, Ventura County, CA.  Numerous defects alleged against general contractor, subcontractor, and material suppliers.  Settled for $4,900,000.

  • Construction Defect Action – 80 Unit Apartment Building, West Los Angeles, CA.  Numerous defects alleged against general contractor and subcontractors.  Settled for $3,400,000.

  • Construction Defect Action – 23 Unit Condominium Project, Los Angeles, CA.  Numerous defects alleged against subcontractors and design professionals.  Monetary recovery included pretrial settlements with 13 defendants totaling $2,150,000.  LHC proceeded to bench trial against remaining concrete subcontractor.  Court awarded $2,600,000 to Plaintiff against concrete subcontractor.  Actual settlement total – $3,250,000.

  • Construction Defect Action– 41 Unit Condominium Project, Playa Del Rey, CA.  Numerous defects alleged against Developer, subcontractors and material suppliers.  Settled for $2,300,000.

  • Construction Defect Action– 39 Unit Condominium Project, North Hollywood, Los Angeles County, CA.  Numerous defects alleged against Developer.  Settled for $1,500,000.

  • Construction Defect Action – Single Family Residence, Los Angeles, CA.  Numerous design and construction defects alleged against general contractor, subcontractor, and design professionals.  Settled for $1,400,000.

  • Construction Defect Action – 17 Unit Condominium Project, Los Angeles, CA.  Numerous defects alleged against general contractor and subcontractors.  Settled for $1,200,000.

  • Construction Defect Action – Single Family Residence, Pacific Palisades,  Los Angeles County, CA.  Alleged numerous defects against general contractor, subcontractors, and design professionals.  Settled for $900,000.

  • Construction Defect Action – 23 Unit Condominium Project, Ventura County, CA. Numerous defects alleged against developer and general contractor. Settled for $900,000.
  • Construction Defect Action – 12 Unit Condominium Project, Pasadena, CA. Numerous defects alleged against developer and general contractor. Settled for $825,000.
  • Construction Defect Action – 29 Unit Condominium Project, Studio City, CA. Numerous defects alleged against developer, general contractor, subcontractors and material suppliers. Settled for $800,000.
  • Construction Defect Action – Non-profit, commercial health and fitness member facility with indoor pool and gym, Ventura County, CA.  Numerous design and construction defects alleged against general contractor, subcontractors, and design professionals.  Settled for $710,000.
  • Construction Defect Action – 60 Unit Condominium Project, Los Angeles, CA.  Alleged window / water intrusion defects and damages against contractor.  Settled for $500,000.

  • Construction Defect Action – 23 Unit Condominium Project, Los Angeles, CA. Numerous defects alleged against developer, general contractor and subcontractors. Settled for $465,000.
  • Construction Defect Action – 7 Unit Condominium Project, Brentwood,  Los Angeles County, CA.  Alleged numerous defects against developer, subcontractors, and design professionals.  Settled for $450,000.

HOMEOWNER ASSOCIATION RESOLUTIONS

  • Homeowners Association Action – LHC represented HOA against homeowner that built illegal block wall, Ventura County, CA.  LHC’s Motion for Summary Judgment was successful, forcing homeowner to remove block wall.

  • Homeowner Dispute – LHC represented homeowner that was sued by neighbor in a planned unit development, Simi Valley, Ventura County, CA.  LHC’s anti-SLAPP motion was successful, resulting in early dismissal of case and significant award of attorney fees to client.  Decision was affirmed on appeal.

  • Homeowner Association Defense – Defended San Luis Obispo County Association, Board members, and Management Company in lawsuit by Plaintiff.  Plaintiff’s lawsuit alleged more than 30 improper acts and omissions against Defendants.  Lawsuit sought monetary and injunctive relief.  Settled for significantly less than Plaintiff’s incurred attorney fees and no injunctive relief.

  • Homeowners Association Action – The firm represented a 300+ unit Planned Unit Development in San Luis Obispo County alleging assessments owed, breach of CC&R’s, injunctive and declaratory relief against homeowner.  The firm was successful at trial, including award of attorney’s fees to client.

  • Homeowners Association Collection / Foreclosure Action, San Luis Obispo and Los Angeles, CA.  LHC represented Association in Collection / Foreclosure action against homeowner.  Homeowner involved subject property in 12 separate bankruptcy cases and filed multiple separate lawsuits to avoid foreclosure.  Result – Association successfully foreclosed on subject property.
